Delivery
- PLACING AN ORDER AND ITS ACCEPTANCE
1.2 Placing your order. Please follow the onscreen prompts when you place an order. Each order you place represents an offer by you to buy the goods specified in the order subject to these Terms.
1.2 Correcting input errors. Our order process makes it easy for you to check and amend any errors before you submit your order to us. Please check your order carefully before confirming it as you are responsible for ensuring your order and any specifications you submit with it are complete and accurate.
1.3 Acknowledging receipt and acceptance of your order. When you place an order, you’ll receive an email from us acknowledging receipt. Our acceptance of your order takes place when we send the email for you to accept it, at which point the Contract between you and us starts.
1.4 If we cannot accept your order. If we’re unable to supply you with the goods for any reason, we’ll notify you by email and we won’t process your order. If you’ve already paid for the goods you ordered, we’ll refund you the full amount including any delivery costs you were charged for as soon as possible.
- DELIVERY, TRANSFER OF RISK AND TITLE
2.1 From receipt of your order and payment of it in full, we aim to deliver within seven working days, if stock permitting. Occasionally, our delivery to you may be affected by an event that’s beyond our control. See clause 14 (‘Events outside our control’) for more information about our responsibilities when this happens.
2.2 Delivery is complete once the Goods have been unloaded at the delivery address set out in your order – the goods will be your responsibility from that time. It is your responsibility to transport the goods from curb side into your premises.
2.3 You'll own the Goods once we've received payment in full, including all applicable delivery charges.
2.4 If we fail to deliver the Goods, our liability is limited to the cost of obtaining replacement goods of a similar description and quality in the most competitive market available, less the price of the goods. However, we won’t be liable to the extent that any failure to deliver was caused by an event outside our control (see 14) or because you didn’t provide adequate delivery instructions or any other instructions that were relevant to the supply of goods or because you provided an inadequate, inaccurate or misleading specification of the goods.
2.5 If you fail to take delivery within 10 days from the day we notified you that the goods were ready for delivery, we may resell part of or all them. Bespoke goods manufactured to your specification will still be chargeable.
2.6 Delivery slots are between 8am - 6pm. Any missed deliveries will be subject to a re-delivery fee. Pre-12 delivery is available at an additional cost.
2.7
(a) Damage, shortages and discrepancies: The Buyer shall be responsible for inspecting the Goods on delivery to check the Goods and packaging for damages, shortages and discrepancies. If there is any damage, shortage or discrepancy with respect of the Goods, the Buyer shall notify Be Quantum within 24 Hours of delivery. If the Buyer fails to do so then Be Quantum shall not be liable for the damage, shortage or discrepancy. A "delivery" or "arrivals" note signed by the Buyer or its agent indicating that the Goods are in good order on arrival shall be conclusive proof of the same and bind the Buyer. Damaged goods must be signed for as “Damaged” or refused delivery.
(b) Goods that fail on installation: Be Quantum operates a returns procedure for Goods that fail on installation. The Buyer must comply with all instructions given to it by Be Quantum in relation to the applicable Goods that fail on installation returns procedure. The Buyer shall notify Be Quantum, within 24 hours, if any Goods appear to have failed. The Buyer must notify Be Quantum of any apparent Goods that fail on installation within 5 working days of delivery.
(c) Goods that fail after installation: Faulty Goods must not be returned to Be Quantum without notice. The Buyer must notify Be Quantum within 3 working days of the fault becoming apparent and follow the instructions notified to it by Be Quantum in relation to the fault.
(d) General provisions relating to Goods that fail on installation and Faulty Goods:
(1) Should the Buyer return the Goods otherwise than as set out in these Terms and Conditions then the Buyer shall pay all Be Quantum costs and expenses in liaising with the manufacturer concerning the return. (2) The Buyer shall pay all Be Quantum costs and expenses if the Goods suspected to be Goods that fail on installation or Faulty Goods prove not to be Goods that fail on installation or Faulty Goods. (3) The Buyer shall be responsible for all transportation and insurance costs relating to returned Goods. (4) Be Quantum shall not be responsible for installation of returned Goods after repair or exchange. (5) Any labour costs and expenses incurred in extracting defective parts and/or components shall be borne by the Buyer and if incurred by Be Quantum shall be paid by the Buyer. (6) The Buyer shall also be responsible for all Be Quantum costs if Be Quantum agrees to collect the Goods for return and such Goods are not ready for collection at the agreed time.
- OUR GOODS
3.1 The images of the goods on our site are for illustrative purposes only. Although we make every effort to display colours of our products accurately, we can’t guarantee that your computer's display will accurately reflect the colour of the goods. The colour of your goods may therefore vary slightly from the images on screen.
3.2 We'll take all reasonable care to be as accurate as possible with our descriptions, in fact all sizes, weights, capacities, dimensions and measurements indicated on our website have a 2% tolerance. Although we aim to keep the website as up to date as possible, the information displayed may not always reflect the exact position of the moment you place your order.
3.3 The packaging of your goods may look different to the images displayed on our site.
3.4 We reserve the right to amend the specification of the Goods if required by any relevant statutory or regulatory requirement.
- RETURNS AND REFUNDS
4.1 You can cancel the Contract and receive a refund if you notify us as we’ve set out in clause 5.3 within seven days of your decision to cancel the Contract. OR within 48 hours of placing your order or within 7 days of receiving your order.
4.2 However, this cancellation right does not apply to bespoke branded goods that have been customised to your requirements.
4.3 To cancel the Contract, you must email us at sales@bequantum.co.uk or contact our Customer Services team by telephone on 020 3488 3897. If you’re emailing us or writing us, please include the details of your order (Order reference number is required) to help us identify it. If you send us your cancellation notice by email or by post, your cancellation will be effective from the date you send us the email or post the letter to us. For example, you will have given us notice in time if your letter is posted on the last day of the cancellation period or emailed to us before midnight on same day.
4.4 If you return your product to us unused in its complete original packaging and we’re therefore able to resell it ‘as new’, you’ll receive a refund of the full price of the product. We’re happy for you to unpack the product to inspect it, in the same way you’d be able to inspect it in a shop, but please be very careful until you’re sure you’re going to keep it. If you’ve used the product, had it installed, begun to input/download data or handled it beyond what’s reasonably necessary to inspect it (including removing screen protectors), we may not be able to resell it. This means that where the value of the product is reduced by actions you’ve taken, we may only make a partial refund, or charge you for the reduction in value.
Damaged items must be signed for as "Damaged" with the courier upon delivery or refused delivery.
4.5 If goods have been delivered to you before you decide to cancel the Contract then you must return them to us without undue delay – no later than 14 days after the order is delivered. You can either send them back or hand them to our authorised carrier (collection fee will apply). Please use the pre-printed returns labels supplied on your delivery note and contact us (see 4.3) to arrange collection. In some cases Restocking fee may apply at 15% of your order.
